The agreement
These terms apply between your organization and Hyperity, the Swedish company operating EngageNudge. You accept them by creating a workspace. The Data Processing Agreement at /dpa is part of this agreement.
The service
EngageNudge provides software to decide when to send web push notifications, and when not to, and to send them. Plans are priced by audience size, with limits described on the pricing page. Sending within normal use is not metered per message.
Your responsibilities
You are responsible for the content you send, for having a lawful basis to message your subscribers, and for following the consent rules that apply to your audience. You confirm that you hold the rights to the content and lists you bring to the service.
Acceptable use
No spam, no misleading or unlawful content, no attempts to reach people who have not opted in. We may pause sending for a workspace that violates this section, and will contact you when we do.
Billing
Paid plans are billed through Stripe, monthly or yearly. You can change or cancel your plan at any time, effective at the end of the paid period. Price changes are announced in advance and never apply retroactively to a running period.
Data processing
How we handle personal data is described in the Privacy Policy at /privacy, the Data Processing Agreement at /dpa, and the subprocessor list at /subprocessors.
Availability
We aim for high availability and announce planned maintenance in advance. Self-service plans carry no contractual uptime guarantee; if you need one, contact us about an enterprise agreement.
Liability
The service is provided as described, within the limits of your plan. To the extent the law allows, our total liability is capped at the fees you paid during the twelve months before the event giving rise to the claim, and neither party is liable for indirect damages.
Termination
You can leave at any time: export your data from the dashboard, then schedule deletion. We may suspend or terminate a workspace for abuse or non-payment, with notice where the situation allows it.
Changes and governing law
When these terms change we update the date at the top and announce material changes to account owners by email. The agreement is governed by Swedish law, and disputes are settled by Swedish courts.
